Thanks for this guest column, Fred. Having done two historical documentary miniseries on the Founders, this beautiful column echoes my deep feelings about what these men did. Yes, they were rich & educated White men, all of whom were ideologically against slavery but many of whom kept slaves anyway to maintain their gentlemanly lifestyles; no, women weren’t included in their original vision, nor were the non-educated.
But they left us a framework flexible enough to move us toward that enlightenment vision of fairness & equity that the Founders envisioned. Even since the Pilgrims, capitalism & corporatism was the counterweight to their imaginings, but the core of the Constitution remained to keep that balance.
Today, the executive branch has completely neutered the legislature, & is engaged in cannibalizing the judiciary.
If any Republican Congressmember, or judge, or lawyer in the DOJ is a part of this, they can’t claim even a thread of the tapestry the Founders weaved for us.
They’re destroying what my ancestors fought for - in every generation since the French & Indian Wars…and they should be treated as the vandals of democracy that they are.
They deserve to be treated lawfully, but that doesn’t mean we have to respect them.
Here in Baghdad By the Sea, we have more Canadians, many with dual citizenship, who pay our taxes, including high Florida real estate taxes, than live in some Canadian provinces. Canadian businesses provide about 54,000 Florida jobs.
Mostly registered Republicans, these folk should consitute a threat to the new Trump/Musk axis of evil.
Meanwhile, we have 3 MAGAT House members representing a majority Democratic county. All are Cuban Americans. They've been protesting immigration policy.
"South Florida congressional members say they are concerned for Cubans, Haitians, Nicaraguans and Venezuelans suddenly under threat of deportation now that the Trump administration is ending a program that gave more than 500,000 immigrants a temporary legal pathway into the United States. “Let’s give them the opportunity to apply for the protections they were promised,” Republican U.S. Rep. Maria Elvira Salazar said in a statement Saturday afternoon."
Thank you for this clear and concise report. Yes, we truly are in a Constitutional Crisis. It concerns me greatly that so many journalists, commentators and Congressmen are not willing to state this. I believe they are not willing to state this because they are afraid to state this. In actually admitting, we are in a crisis also admits that we have failed. We have failed to defend and hold true to our constitution. But we can never defend the constitution if we cannot admit when there is an enemy of the constitution. The enemy is here, the enemy is at the gate, the enemy is in the White House!
Very informative article, thank you! However, I’ve only been hearing/reading stories about the Executive vs. the Judicial Branches, while Congress seems to be getting off Scot-free! Can we, the people, bring some sort of lawsuit against the congressional body for not upholding the constitution over fealty to Trump? If Congress was doing their job they would be challenging their loss of constitutional powers that the Executive Branch has taken from them. How can we say that there are three co-equal branches of government when only two are fighting to maintain their powers?
Fantastic essay. It is everything I've been asking and ruminating on, to be best answered, by the SCOTUS, but if and when. They don't like "definite".
Even if Roberts is a fan of the UET, that isn't what Hamilton argued in Fed 70, I don't believe, but who the heck am I?
Unity versus plurality? Unity as dictator or King?
While much has been done to give the Executive more powers, it certainly shouldn't have rewarded a felon, 45ish days after he was convicted, the criminal immunity he sought, and sit on said decision for 4 score and 8 months-ish so We The People, in our civic duty, not to be voters but blind jurists.
I have doubts in this court. We have two definite NOs in Alito and Thomas and Thomas, as the least effective self arbiter, should recuse, due to his wife's emboldened moves in her involvement on 1/6/21.
I like Beer, as I call Kav, had cover from Barr so I don't know.
Gorsuch surprised me, as when in CO he voted in favor of the 14th and now, like the Aliens Act of 800 B.C. is brought out and dusted off, the 14th was a moot article in an amendment which would only cause CHAOS. CHAOS?
The question has been portrayed in the simple light I have craved for what feels like my entire life which ain't short.
Thank you for this explanation. The path forward must be defined.
I believe that Trump and his supporters and enablers use the immunity decision as the easiest way to say he is all powerful and get away with it. It must be denied, re-thought, some legalese that overturns this decision or something to clarify the haze of WTH.
How can a civil immunity precedent and executive privilege in a subpoena, along with a favorable view, versus a critics view, of the UET, in Hamilton's Fed 70, bring us back to King George the III?
That is why I'm here and reading. I just would like answers and today I feel as if the right argument was just made and why.

Trump's downfall is that many Congressional Republicans did not sign up to be members of the axis of evil. Pressure them.
Call. Write. Picket. Sit in.

2 of the 3 had been Dems. One, born in Cuba had been our Democratic county mayor, supported HRC in 2016, but switched to run for Congress in 2020.
Only takes 3 to flip the House.

This column is extraordinary. Thank you so much sharing. This articulates beautifully the runway to the clear danger we are now facing.

Thank you, again.
Great piece. Thank you.
January 20, 2025 - It was a constitutional crisis the day that criminal, domestic terrorist and con artist took “Office”.
The Association of American Law Schools ,
The American Bar Association , & The American Judges Association should join forces to help restore the Rule of Law.
We need them to stand united in defense of Stare Decisis consensus, & render support of The Rule of Law.
